[5897] In 1759, Amos married Abigail Dimmock who was twenty-three years younger than him. Their eldest child, Shubael, was born in 1760. According to his father's will of 3/15/1753, Amos was to inherit his father's land in Mansfield & support his mother, Eunice. Amos & family left Mansfield after the death of his mother who died in Dec. 1766, relocating to Clarendon, VT, in 1770 where the family settled along Otter Creek in the section which was part of the NY Grant.

Here is how historian and author, Dawn Hance, described Amos's farm at Clarendon: "This farm is located on the Middle Road in Clarendon not far from the Rutland line. On the 1869 map, it belongs to J.A. Nelson. Jacob Marsh sold lot number 6 on the Socialborough plan to his brother, Amos Marsh, in 1774. This hundred-acre lot, bounded on the west by Otter Creek, was the home farm of Amos Marsh at his death in 1778. His widow, Abigail, married Ebenezer Howard, who sold the premises to Reuben Pitcher, (no deed). Reuben Pitcher sold to Ebenezer Pitcher March 12, 1786, Bk.4, pg.5. In that deed, it says, "the farm I bought of Ebenezer Howard...", "same farm Amos Marsh died seized. "(Ebenezer may have sold knowingly or unknowingly. In January of 1791, the legislature passed an act enabling the Marsh heirs to recover their property from Ebenezer & Ebenezer Pitcher, Jr. Most of the Marsh heirs and the Pitchers had conveyed their interest to Daniel Marsh by 1798. The land was later owned by Jonathan Parker, Jr. and the lot north of it which was lot 7 on the Socialborough plan."

In 1769, brothers, Amos and Jacob Marsh, and their two nephews, William and Daniel Marsh who were brothers and sons of the deceased Rev. Wm. Marsh, had all come to Clarendon together. Vermont had not yet become a state but was part of New York Province. The Marshes settled at Clarendon having attained a NY grant. In 1772, Jacob, had purchased 600 acres of land in this area that was then divided among seven men who had come to Clarendon. These 7 lots were known as the Socialborough Plan. Daniel Marsh settled on Lot #1; Whitfield Foster on Lot #2; Oliver Arnold on Lot #3; Jacob Marsh on Lot #4; Thomas Brayton on Lot #5; Amos Mash Lot #6 which was near the Rutland line; Samuel Place was on Lot #7. Lot #1 was the most southerly, and Lot #7 was the most northerly on Middle Rd. Jacob settled on what was later known (1869 platt map) as the Strong farm, Amos on the Nelson farm, and nephew, Daniel, acquired the Platt farm. Marsh Cemetery is located just south of Lot #1 on the disputed lot ( Daniel Marsh & Silas Whitney both claimed this 100-acre parcel). The property north of the cemetery was the site of Esq. Daniel Marsh's original farm (Lot #1) Jacob Marsh's land was later owned by David Warner. There is a road between Lot 3 & Lot 4 called Military Rd.

At the same time that the Marshes moved to the area, the governor of NH was also taking claim to this area and was giving out grants for the same land. Needless to say, it caused grave trouble that only intensified as time went on. Ethan Allen and his Green Mountain Boys supported the NH grants and were at great odds with those settling under the NY grants. So it seems Ethan Allen and his mob hated the Marshes as well as other settlers who had settled under the NY grants. The persecution can be seen in the following excerpt from the book, "THE EMERGENCE OF LIBERAL DEMOCRACY IN VERMONT 1760 - 1880" written by Robert E. Shalhope, published by The Johns Hopkins University Press in 1996:

p. 90

"Before leaving Durham, Allen and his band of men set fire to several other houses and thoroughly terrorized the inhabitants of the township.

Five days later, Jacob Marsh, another Justice of the Peace in Charlotte Co., suffered a similar fate. Captured by Warner and Baker while passing through Arlington, Marsh faced a judgment seat occupied by Samuel Tubbs, Nathaniel Spencer, and Phillip Perry. Warner charged him with purchasing land under a NY title, discouraging settlers from holding NH titles, and accepting a commission from the governor of NY. Baker also charged that Marsh had publicly reproved him for damning the governor of NY and had threatened to bring charges against him for swearing and blasphemy. Baker demanded that Marsh be whipped severely, but the court merely ordered him not to encourage settlement under the NY titles; in addition he must give up his NY commission as justice of the peace. If he did not obey these conditions, his house would be burned. Before being released, Marsh received a slip of paper signed by the 3 judges. It certified that Marsh "haith ben Exseamined, and had on fare Trial." So that our mob shall not medeal farther with him as long as he behaves. Sartified by us his Judges to yet."

Author, Robert Shalhope, states: "From that time on Marsh refused to act as Justice of Peace."

The following is a continuation of the above story taken from "THE MEMOIRS OF WILLIAM MARSH" which was written by Jacob's grandson, Rev. Israel Marsh. It appeared in "THE REGISTAR" of Montreal on July 27, 1843:

That the said Remember Baker who had frequently insisted to have the deponent adjudged to be whipped when the deponent was dismissed, threatened him, cursed him and promised to punish him the deponent if he should ever meet him and have an opportunity. That when the deponent arrived at his own house he found that the same Mob or company had been to his house in his absence and had taken off the roof of his house, and that he the deponent was informed and verily believes that only the interposition of some of his friends prevented them from burning the roof of the house after it was taken off; That they destroyed several bushels of corn, split a number of boards and did him some other damages. That he the deponent has been informed that John Smith and Peleg Sunderland (both of Socialborough) were Captains or Leaders of the Mob, who had been at his house, and Benjamin Cooley and one Silvanus Brown, their Lieutenants, or next in command and mischief and that the company then with them amounted to forty or fifty armed men. And the deponent farther saith that he verily believes that if he should act in his office of a Justice of peace in the said county of Charlotte, that his effects and property would be destroyed by the said Mob or some of them as far as would be in their power; and that his life would be in danger, and further the deponent saith not. (During a visit to Boston, Linda Stowe Miller, a descendant of Amos, visited the N.E.H.G.S. Library and found text of a couple letters Ethan Allen and the Green Mountain Boys wrote to Amos Marsh).

By 1774-75, there was a fever of discord, dividing neighbors and friends over the cause of liberty. Tensions kept mounting; and by 1777, General Burgoyne had orders to come down from Quebec and Montreal, through Lake Champlain to take Albany, NY. The land issue was set aside with the greater issue at hand, the Rev. War. Most settlers who had settled under the NY grants, became Loyalists, joining the British forces; while those holding the NH titles, fought on the American side.

Amos was relatively old (58) when the Revolutionary War broke out. It was about July 1777, when Amos and son, Shubael, enlisted in the Queen's Loyal Rangers commanded by Lt. Col. John Peters of Bradford, VT.** Many of Amos's neighbors joined as well, including his next door neighbor to the north, Samuel Place. Peters was selected by Gen. John Burgoyne in May 1777 to raise a regiment of rangers to serve with his army in the invasion which was about to start. Three hundred refugees had enlisted. Totally, 600 men had joined the regiment of rangers from May 1777 through the Battle of Saratoga in October 1777. This regiment took part in the operations around Ft. Ticonderoga and at the Battles of Hubbardton & Bennington. It appears that Amos & Shubael were captured and possibly taken prisoner while on a Scouting Party under John Peter's command which preceded the Battle of Bennington. When those of the American side found that Amos had joined the Queen's Loyal Rangers, they confiscated his oxen and sold them; but they did not confiscate his land. It appears that rather than fight the Americans, he decided to side with them.

Patra Anne Hepworth indicated that Amos gave cows to his daughters. I am not sure if this was in the same time frame when oxen were confiscated from him.

A probate record for Amos Marsh states that he died September 15, 1778 (file #79) and can be found at the Rutland Co. Probate Office, 83 Center Street, Rutland, VT 05701, phone: 802-775--0114. Also, Amos Marsh signed a document in April 1778 having to do with payment for helping hurting Tory families in the area. This document, too, would indicate that he died after the Battle of Bennington. We have no written record of the date of Amos & Shubael's deaths. The only record we have of them losing their lives at the Battle of Bennington is its appearance on the applications of three descendants of Amos who became members of the DAR based on their ancestor, Amos. Amos signed the Oath of Fidelity in 1777 and according to his DAR descendants, Amos served in Colonel Noadiah Hooker's Regt., in Capt. Lachem Case's Company, CT Militia for the Continental Line in 1777, serving at Piekskill, White Plains, Fishkill and Fort Montgomery, all of which are located near the Hudson River north of NYC.

An account of Amos's service is found in: "Connecticut Military Records 1775 - 1848" on page 499. This book states his induction date to serve at Fishkill, NY as 4/12/77 and his discharge date as 5/27/77 (only a period of about 6 wks.)

American troops were being summoned and gathered at Manchester, VT, to march toward Bennington. These troops were to stop the British who were now camped west of Bennington from making their move to overtake and confiscate American supplies. The Vermont Council of Safety had commissioned General John Stark to represent them in the stopping of the British Troops sent into the area by General Burgoyne. General Stark, representing the State of VT , was gathering men and had summoned help from New Hampshire, MA, and a small contingent from the CT Militia. Careful search has indicated that about 40 men from NY joined Stark's forces and also participated. Shortly, General Stark had about 2200 men gathered and was now ready to move in on the British.

Lt. Col. Baum, a Hessian, was in charge of the British forces dispatched by British General Burgoyne to go to Bennington. However, the British were apparently unaware of the troops being gathered by Stark and had no idea they had a rattlesnake on their hands. Because of the lack of supplies and being outnumbered, the British lost this battle, losing about 207 men, with another 700 taken prisoner. The American losses were 30 dead and 40 wounded. The Battle of Bennington took place August 16, 1777 proving to be an American victory.

Amos's brother, Jacob, was killed in the Am. Revolution with Jacob fighting for the British as a Tory or Loyalist, losing his life at the Battle of Saratoga near Stillwater. Another brother, Joseph, was a Select-man for MA in 1771, 1772 and 1777, also serving in the War. A first cousin, Col. William S. Marsh, was a Green Mt. Boy who later became a Tory, fighting under General Burgoyne. A nephew, Abraham Marsh, was also a Loyalist. William & Abraham Marsh married the French cousins with one's father being Capt. Jeremiah French, a Loyalist in the Rev. War. Other cousins in the Rev. were brothers, Joel, James, & Nathaniel Marsh, sons of Isaac and Mary Gilbert/Marsh of Sharon, VT, who fought on the American side. In their later years, both Joseph and Col. William S. Marsh lived in Hinesburg and Manchester, VT, respectively, living out the remainder of their lives.

Most of the Marshes were Loyalists and it is believed that Amos wavered regarding which side to support. Perhaps even after taking the Oath of Fidelity, he changed his mind, joining the British side when joining the Queen's Loyal Rangers. It has been said that changing of sides by Vermonters indeed happened during the Revolution.

In January, 1777, the settlers of VT declared their independence and adopted "New Connecticut" as the name of their little republic; and in July, 1777, a constitution was adopted and Vermont took its present name. The land disputes were finally settled in 1790, when the state "bought itself free" from NY by paying $30,000 for all disputed territory. Vermont was an independent state for 14 years and was not recognized by Congress until March 4, 18l1, when it was admitted as the 14th state of the Union.

Abigail, remarried a few years after Amos's death to Ebenezer Howard. They may have settled in Rutland, VT. However, Abigail again became widowed after less than ten years of marriage. The property belonging to her first husband, Amos, was sold in 1792 to Daniel Marsh, nephew of Amos. Most of the heirs sold their portion to Daniel. At this time, Abigail was listed as widow of Ebenezer Howard, and it was said she was from Rutland.

Amos and Abigail Dimmock Marsh had at least 8 children: Shubael, 1760; Eunice, 1762; William,1764; Amos, Jr., 1767; Lemuel, Abt. 1772; Daniel, Abt. 1774; Lydia, 1776; and Israel, 1777 and possible two more unnamed children. Amos had six children listed in a 1770 petition. So there may be two more unnamed children. Most of Amos's children were assigned guardians after the death of their father. Wm. & Amos were raised by Amos Robinson, Lemuel had a couple of guardians. A cousin, Daniel Marsh, raised Daniel the 2nd as well as later Lemuel, Lydia & Israel. It is not known why Abigail & second husband gave up their guardianship of Lemuel, Lydia & Israel in 1783. Perhaps their stepfather, Ebenezer Howard, was ailing & could not support them. We know that he died prior to 1792.

Amos's birth date was listed as September 25,1736 on the applications of three of his descendants who became members of the D.A.R. (Daughters of the American Revolution): Abigail Stuart Marsh, and sisters, Edna Hemingway Babbitt and Ella Hemingway Smith. This birth date is obviously an error for it is matches the birth date of Mathias, Amos's youngest brother. The birth date should be: June 7, 1719.
