I have also seen Daniel's birth date as 12/19/1748 as claimed by Dawn Hance, historian.
Daniel was about 14 when he lost his father who was killed by Indians in the Wyoming Valley of Pennsylvania. He had a younger brother, William. About six yrs. later in 1769, Daniel & Wm. came to Clarendon, VT with their uncles, Amos and Jacob Marsh. Daniel was a farmer and settled in North Clarendon on what later came to be known as the Platt Farm. He served in the Rev. War as a private, and later became a statesman. During the Revolution, he carried baggage for the troops that went to Canada in Feb. 1778. He was in Capt. Josh Hayden's Co., Col. Wood's Regt. that marched to Brookfield in the Alarm of Oct. 1780 and was on the payroll for 3 days. In Feb. 1787, he successfully petitioned the General Assembly to consider his service of 16 days in providing hay, horses, and transportation for Capt. Oliver Potter's Co. to Montreal during the Canadian Expedition of 1775 and was granted status as a Revolutionary soldier. Daniel was described as a complex man and seemed to waver as to which side to support.
Daniel was also known as a Loyalist; and when Vermont's Court of Confiscation met on April 23, 1778, Daniel Marsh, along with 20 other men had their property, possessions, and citizenship stripped away. It was said that he was "a prisoner who was taken by American troops from within the enemy lines." Also, according to Dawn Hance, an historian who has written six books on the Rutland County, VT, area. She states that Daniel was on an American prisoner ship in Boston Harbor and was rescued by Elisha Williams, an influential man of the area who was related to his mother. It is felt that Daniel's family lived with the William's family in Rutland while Daniel was being held prisoner.
It appears that later Daniel's family left Vermont, as did most Clarendon residents during the Rev. War, going to New Milford, CT, where two of his children were born (bet. 1779 - 1782). There was a Daniel and John Marsh who served as witnesses in Duchess County when the will of Agrippa Martin was probated in 1782. It is not known whether it was this Daniel, but it is a possibility since he and family were at New Milford in 1782. John Marsh would have been Agrippa's brother-in-law and Daniel, a first cousin to Agrippa's wife.
After the war, many families who lost their property and possessions left the Clarendon area, but Daniel chose to fight in the court system to retain his land, and indeed it was a long fight. On Feb. 23, 1782, the General Assembly passed an act allowing Daniel to "take peaceable possession thereof. "Soon after his return, on Dec. 16, 1782, the town voted to receive him as a good, wholesome inhabitant." But by 1784, he still was not in possession of his farm due to losing two local lawsuits. It was by the passing of the "Quieting Act of June 17, 1785" that Daniel was again given valid title to his property and compensation for court costs. Daniel was said to be the originator & advocator of this act and was a member of the Legislature at this time. In the interim, Silas Whitney occupied part of Daniel's property to the south of his original farm (Lot #1). After some time disputing as to whom was the rightful owner, Daniel ended up paying Silas 200 pounds and got the property back. Also, when Daniel's original farm was confiscated, it was sold to John Seaman who in turn rented it to Jerethemal Powers, father of Moses Powers. Daniel was said to have gone with friends taking hay after the renter had cut it. Jerethemal cut the hay and was said to be having dinner while Daniel got the hay. So the sower was not always the reaper. It was not until 1792, after the repealing of ordinances against him, that he was finally given back all his properties. Daniel was apparently supported by many of his neighbors and was elected Clarendon Town Representative 1784 - 1788. He also served as a Justice of the Peace and records indicate that he married several couples between 1793- 1797. In 1788 Daniel was employed by the Postmaster General of Vermont as a post rider. His route took him to the Onion River and ended in Jericho, VT, in northern Vermont.
In 1790's, Daniel bought farmland from the heirs of his Uncle Amos's farm. Amos had died in September 1778 during the Revolution.
Daniel became the guardian of Amos's son, Daniel, in 1781 and then guardian of three more of Amos's children in 1790: Lemuel, Lydia & Israel. By this time, Daniel & Phebe already had about 7 children of their own. So they had about 11 children to raise.
Both of Daniel's uncles, Jacob and Amos Marsh, died during the Rev. War. Jacob was a Loyalist who died at the Battle of Saratoga.
Daniel's home farm was purchased by son, Randall, from the heirs.
Daniel's sons, Gurley & Daniel, Jr., married the White sisters. Sons, Randall & Henry married Luthers who may have been sisters.
Daniel and many of his descendants are buried at the Old Marsh Cemetery which is located on the disputed lot just to the south of his original farm on Middle Rd. In 1970, a cemetery list was prepared by Winona Gilmore who counted 73 graves with at least 20 being Marshes. It is claimed that the cemetery was established in 1789. The last person buried there was probably William Croft Marsh in 1943.
An epitaph was written in a death record book from Clarendon: "Sacred to the memory of Daniel Marsh, Esq. who in the 60th yr. of his age, supported with an unshakable belief of a blessed immortality and final restoration of all things, calmly departed this life 2/29/1808."
